2 User Obligations and Prohibited Content

• Account Accountability: Users are solely and fully responsible for all listings, messages, materials, and activities conducted under their registered account.
• Prohibited Items and Conduct: You agree not to post, advertise, sell, or distribute:
  • Illegal goods, substances, or services under Indian law.
  • Stolen, compromised, or misappropriated property.
  • Counterfeit, replica, pirated, or unauthorized trademarked items.
  • Spam, fraudulent schemes, deceptive advertisements, or repetitive duplicate postings.
• Enforcement: We reserve the unilateral right to remove non-compliant content and suspend or permanently terminate any account that violates our community standards, policies, or applicable laws, without prior notice or refund.

3 Intermediary Status and Safe Harbor Protection

ClasyAds operates strictly as an online intermediary platform under the Information Technology Act, 2000, and applicable Intermediary Guidelines.

• No Endorsement: ClasyAds does not pre-screen, verify, endorse, or guarantee any user-generated content, listings, products, or services.
• No Active Involvement: ClasyAds is not a party to, nor responsible for monitoring, any negotiation, direct interaction, transaction, or contract between buyers, sellers, or third-party providers.
• Safe Harbor Immunity: In accordance with statutory safe harbor principles, ClasyAds and Om Vasudev Associates shall not be held liable for any third-party information, data, listing, communication link, or material made available or hosted on the Platform.

4 Limitation of Liability and "As-Is" Disclaimer

• Zero Liability: To the maximum extent permitted by law, in no event shall Om Vasudev Associates, ClasyAds, its directors, officers, employees, affiliates, or agents be liable for any direct, indirect, incidental, special, punitive, or consequential damages (including loss of profits, goodwill, data, or business opportunities) arising out of the use of, or inability to use, the Platform.
• Use at Own Risk: All services and features are provided on an "As Is" and "As Available" basis without warranties of any kind, express or implied.
• User Due Diligence: Users must exercise their own independent judgment, caution, and verification before engaging in any transaction or relying on listing information.

5 Advertisement Services

• Featured Ads: Highlights listings in designated sections sequentially to enhance visibility. ClasyAds does not guarantee specific lead volumes, inquiries, or sales. Active duration is limited to the purchased package timeline or a maximum of 30 days from the original posting date, whichever is earlier.
• Bump-Up Ads: Elevates an existing advertisement to the top of its designated category listing. The listing shifts downward naturally as subsequent ads are posted. Bump-Up features do not extend the standard 30-day posting validity.
• Latest Listings: Standard listing placement subject to category-specific chronological ordering with a maximum 30-day validity from the initial posting date.
• Listing Management: ClasyAds reserves the right to edit, reclassify, moderate, or limit adjustments to any ad at its sole discretion.

6 Commercial Policies

• Cancellation & Refund Policy: All listing fees, promotional ad packages, and feature purchases are strictly non-cancellable and non-refundable once processed.
• Shipping Policy: Shipping is not applicable as the Platform operates solely as an online advertising and listing service.
• Return Policy: Returns are not applicable due to the intangible, digital nature of the services provided.

7 Intellectual Property

All Platform designs, visual interfaces, graphics, source code, logos, and proprietary materials belong to or are licensed to Om Vasudev Associates. Any unauthorized reproduction, copying, distribution, or commercial exploitation is strictly prohibited without prior written consent. Third-party trademarks featured on the site are the property of their respective owners.

8 External Links and Payment Authorizations

• Third-Party Links: The Platform may contain links to external websites for user convenience. We do not endorse or assume liability for the content, practices, or policies of third-party platforms.
• Payment Decline Disclaimer: We bear no liability for any loss, failed order, or damages resulting directly or indirectly from transaction authorization declines, technical failures, or preset card limit breaches set by issuing banks or acquiring partners.

9 Governing Law and Jurisdiction

These Terms shall be governed by, interpreted, and enforced in accordance with the laws of India. Any dispute, legal action, or proceeding arising out of or related to the Platform shall be subject to the exclusive jurisdiction of the competent courts of India.
