Intermediary Safe Harbour Policy & Section 79 Compliance Notice

Last Statutory Review: August 19, 2026 • Published in compliance with Rule 3(1) of the Information Technology (Intermediary Guidelines) Rules, 2021.

1. Statement of Intermediary Role under Section 79

ClasyAds Marketplace ("ClasyAds") is an "Intermediary" as defined under Section 2(1)(w) of the Information Technology Act, 2000. ClasyAds provides an automated online electronic communications network and marketplace platform allowing third-party users, sellers, and buyers to create, publish, view, and interact with classified advertisements.

Under Section 79 of the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, ClasyAds is not liable for any third-party information, data, or communication link made available or hosted on the platform, provided the statutory due diligence requirements set out herein are observed.

2. User Due Diligence & Prohibited Content (Rule 3(1)(b))

In accordance with Rule 3(1)(b) of the Intermediary Guidelines Rules 2021, all users, advertisers, and sellers are hereby notified that they shall NOT host, display, upload, modify, publish, transmit, store, update, or share any information that:

  • (a) Belongs to another person and to which the user does not have any right;
  • (b) Is defamatory, obscene, pornographic, pedophilic, invasive of another's privacy, including bodily privacy, insulting or harassing on the basis of gender, libelous, racially or ethnically objectionable, or encouraging money laundering or gambling;
  • (c) Is harmful to child or minors in any manner;
  • (d) Infringes any patent, trademark, copyright, design, trade secret, or other proprietary rights;
  • (e) Deceives or misleads the addressee about the origin of the message or knowingly communicates misinformation;
  • (f) Impersonates another person or entity;
  • (g) Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign States, or public order;
  • (h) Contains software virus or any other computer code designed to interrupt, destroy, or limit the functionality of any computer resource;
  • (i) Violates any law for the time being in force (including wildlife protection, arms act, NDPS, drugs and cosmetics act, or banned goods).

3. Notice & Takedown Mechanism (Expedited Redressal)

ClasyAds follows a robust Notice-and-Takedown procedure. Upon obtaining actual knowledge or being notified by an aggrieved individual, rights holder, court order, or authorized government agency:

⚡ 24-Hour Expedited Takedown

For complaints regarding non-consensual intimate imagery, nudity, sexual acts, or deepfakes under Rule 3(2)(b), ClasyAds disables access within 24 hours of receipt.

⚖️ 15-Day Statutory Grievance Resolution

All other grievances (IPR, fraud, defamation, prohibited items) are acknowledged in 24 hours and fully investigated and resolved within 15 days.

5. Assistance to Law Enforcement & Government Agencies

Under Rule 3(1)(j) of the IT Rules 2021, ClasyAds provides lawful assistance and information to authorized cyber crime and law enforcement agencies within 72 hours of receipt of an official order for cyber security incidents or legal investigations.
